第一章总则
第一条(宗旨和依据)
为了调节解决公共机构的人事争议,保护双方的合法权益纠纷和促进人才的合理流动,制定本程序依照国家有关规定,考虑到本市的实际情况。
第二条(适用范围)
本市行政区域内的事业单位与其聘用人员因设立、变更、终止、解除劳动关系发生的争议(以下简称人事争议)的处理,适用本办法。
地方民办非企业单位、使用事业单位职权的社会团体与其聘用的职工之间发生的劳动关系的设立、变更、终止、解除等争议,可以按照本办法处理。
按照国家公务员制度管理人员的事业单位不适用本办法。
第三条(解决原则)
人事争议的处理应当以事实为依据,以法律为准绳,遵循及时、公平、合理的原则。
第四条(结算方式)
发生人事争议后,甲乙双方可通过以下方式解决:
(一)自行协商;
(二)申请调解;
(三)申请仲裁。
当事人对人事争议的仲裁裁决不服的,可以依法向人民法院起诉。
第二章中介
第五条(调解机构)
事业单位可以设立人事争议调解委员会。人事争议调解委员会由下列人员组成:
(一)职工代表大会或者职工大会选举的职工代表;
(二)法定代表人或者其指定的代表人;
(三)工会委派的代表。
人事争议调解委员会由工会委派代表担任主任,办事机构设在工会委员会内。
事业单位的上级主管部门可以指定专门调解机构对人事争议进行调解。
第6条(调解规定)
发生人事争议后,当事人申请调解的,由人事争议调解委员会或其指定的专门调解机构(以下简称调解机构)根据事实,督促双方自愿达成调解协议。
调解协议的内容不得违反法律、法规和规章的规定。
第七条(调解程序)
当事人向调解机构申请调解的,调解机构应当及时调解。一方当事人提出调处申请的,应当征得另一方当事人同意后,方可进行调处。
调解过程中,调解机构应当听取当事人双方的陈述,按照规定秉公调解。
经调解达成协议的,调解机构应当制作调解书,经双方当事人签署后生效;调解不成的,调解机构应当制作调解意见书,通知双方当事人可以向人事争议仲裁委员会申请仲裁。
调解机构应当确保人事争议双方当事人履行调解协议。
第八条(调解期限)
当事人向调解机构申请调解后,调解机构应当自争议发生之日起50日内完成调解程序;逾期调解未完成的,视为调解失败。
第三章仲裁
第九条(仲裁委员会的设立和组成)
市和区、县设立人事争议仲裁委员会(以下简称仲裁委员会)。仲裁委员会由下列人员组成:
(一)主管人事行政部门代表;
(二)总工会代表;
(3)其他有关政府部门的代表。

第九条(仲裁委员会的设立和组成)
市和区、县设立人事争议仲裁委员会(以下简称仲裁委员会)。仲裁委员会由下列人员组成:
(一)主管人事行政部门代表;
(二)总工会代表;
(3)其他有关政府部门的代表。
仲裁委员会由奇数名委员组成,主管人事行政部门代表担任主任。
第十条(仲裁委员会办事机构)
仲裁委员会设办事机构,负责仲裁案件的受理、仲裁文件的送达、档案管理、仲裁费用的收取和管理等日常工作。
仲裁委员会的办事机构设在本级人民政府人事行政主管部门。
第十一条(仲裁庭)
仲裁委员会处理人事争议,实行仲裁庭制度。仲裁庭由三名仲裁员组成,由仲裁委员会指定一名仲裁员担任首席仲裁员;对简单的人事争议案件,仲裁委员会可以指定一名仲裁员为独任仲裁员。
第十二条(仲裁人)
仲裁委员会可以聘任政府有关部门工作人员、专家、学者、律师专职或者兼职仲裁员。
兼职仲裁员履行公务时,享有与专职仲裁员相同的权利。
第十三条(仲裁管辖)
经市人民政府及其有关主管部门批准设立的事业单位和中央政府部门驻上海的机构以及其他省、直辖市的机构发生的人事纠纷,属于市仲裁委员会的管辖范围。
经区、县人民政府或者有关主管部门批准设立的事业单位发生的人事纠纷,由区、县仲裁委员会管辖。
区县仲裁委员会对管辖有不同意见的,由市仲裁委员会指定管辖。
第十四条(仲裁申请)
当事人应当在人事争议发生之日起60日内,以书面形式向有管辖权的仲裁委员会申请仲裁。
仲裁申请书应当载明下列事项:
(一)申请人、被申请人是个人的,应当写明姓名、性别、年龄、职业、工作单位和住所;请求人、被请求人是单位的,应当写明单位的名称、地址、法定代表人或者主要负责人的姓名、职务;
(二)申请的事项、所依据的事实和理由;
(三)证据及其来源,证人姓名、住所。
第十五条(受理仲裁)
仲裁委员会应当自收到仲裁申请之日起7个工作日内作出受理或者不予受理的决定。委员会作出驳回决定的,应当自作出决定之日起7个工作日内书面通知申请人,并说明驳回理由。本会作出受理决定的,应当自作出决定之日起7个工作日内书面通知申请人,将仲裁申请书副本送达被申请人,并组成仲裁庭。
被申请人应当自收到仲裁申请书副本之日起10个工作日内提交答辩书和有关证据。被申请人未及时提交或者未提交答辩书的,不影响仲裁程序的进行。
第十六条(仲裁庭调解)
双方愿意接受调解的,仲裁庭在查明事实、追究责任的基础上,应当促使双方自愿达成协议。协议内容不得违反法律、法规和规章的规定。
经调解达成协议的,仲裁庭应当制作调解决定书。调解决定自签署之日起发生法律效力
被申请人应当自收到仲裁申请书副本之日起10个工作日内提交答辩书和有关证据。被申请人未及时提交或者未提交答辩书的,不影响仲裁程序的进行。
第十六条(仲裁庭调解)

第十七条(仲裁方式)
仲裁应举行听证会。仲裁庭应当在开庭前5个工作日将开庭时间、地点和仲裁庭组成人员名单书面通知双方当事人。当事人约定不开庭的,也可以书面仲裁。
第18条(不作为撤回申请及仲裁之行为)
在决定举行听证会仲裁申请仲裁,但未能出席听证会上没有任何正当理由,尽管他是书面通知,或离开法庭听证会之前在仲裁庭的未经许可,应用程序可能被视为撤回。
被申请人经书面通知,无正当理由不到庭的,或者未经仲裁庭许可,在开庭前离庭的,可以缺席仲裁。
第十九条(证据)
当事人应当为自己的主张提供证据,国家另有规定的除外。
仲裁庭认为必要时,可以自行收集证据。
只有经过质证确认的证据,才能作为认定事实的依据。
第二十条(辩论)
当事人有权在仲裁过程中进行辩论。辩论结束时,首席仲裁员或者独任仲裁员应当征求当事人的最终意见。
第二十一条(仲裁裁决)
仲裁人事争议案件,应当遵循少数服从多数的原则,正确记录不同意见。仲裁庭不能达成多数意见时,按照首席仲裁员的意见作出裁决。仲裁庭或者独任仲裁员应当在作出裁决后5个工作日内制作仲裁裁决书。
仲裁裁决应当国家仲裁请求、事实根据纠纷,仲裁结果和原因,仲裁费用的分配,提起诉讼的期限,依法向人民法院起诉的拒绝接受仲裁裁决,仲裁裁决的日期。仲裁裁决书由仲裁庭成员签名,加盖仲裁委员会印章。
第二十二条(特殊案件的处理)
仲裁庭在处理重大、疑难的人事争议案件时,可以提请仲裁委员会讨论决定。仲裁庭应当执行仲裁委员会的决定。
第二十三条(结案期限)
仲裁庭审理人事争议案件,应当自仲裁庭组成之日起六十日内结案;必要时,经仲裁委员会批准,可以对复杂案件适当延期结案,但延期不超过30日。
第二十四条(授权代表)
当事人可以委托一至二人代为仲裁。委托第三人代理的,应当向仲裁委员会提交由被代理人签名或者盖章的授权委托书。委托书应当载明委托事项和权限。
第二十五条(仲裁员回避)
在下列情况下,仲裁员应当回避,当事人及其代表也有权提出异议:
(1)他仲裁裁决应当国家仲裁请求、事实根据纠纷,仲裁结果和原因,仲裁费用的分配,提起诉讼的期限,依法向人民法院起诉的拒绝接受仲裁裁决,仲裁裁决的日期。仲裁裁决书由仲裁庭成员签名,加盖仲裁委员会印章。

当事人或者其代表提出质疑,应当说明理由,在首次开庭前提出。第一次开庭后知道质疑事由的,可以在最后一次开庭结束前提出。
仲裁委员会收到异议后,应当自提出异议之日起3个工作日内作出书面决定。
第四章法律责任与救济
第二十六条(当事人的法律责任)
当事人及其有关人员在仲裁过程中有下列行为之一的,仲裁委员会可以予以批评、教育、责令改正。情节严重,违反《中华人民共和国治安管理处罚条例》有关规定的,公安部门可以依法给予行政处罚;构成犯罪的,依法追究刑事责任:
(一)干扰仲裁程序的;
(二)提供虚假信息的;
(三)对仲裁员或者其他工作人员、仲裁参与人、证人实施报复的。
第二十七条(仲裁员和其他工作人员的法律责任)
仲裁员或其他工作人员从事不法行为自私的目的,接受贿赂,上半身,滥用权力,或侵害当事人的合法权益,在仲裁程序中,仲裁员应取消仲裁员由仲裁委员会驳回了,而另一工作人员应由仲裁委员会驳回了;构成犯罪的,依法追究刑事责任。
第二十八条(诉讼与执行)
当事人对人事争议仲裁裁决不服的,可以自收到仲裁裁决书之日起十五日内向人民法院依法提起诉讼。当事人一方在法定期间不提起诉讼或者不履行仲裁裁决的,另一方可以申请人民法院执行。
第五章附则
第二十九条(仲裁费用)
当事人申请人事争议仲裁,应当按照规定交纳仲裁费。
第三十条(生效日期)
本办法自2004年10月24日起施行。《上海市事业单位劳动合同争议处理办法》(沪办[2003]3号)同时废止。

   Chapter I General Provisions
  Article 1 (Purposeand Basis)
  With a view to regulating the settlementof personnel disputes in public institutions, protecting the legitimate rightsand interests of both parties to disputes and facilitating the rationalmobility of qualified personnel, these Procedures are formulated in accordancewith relevant provisions of the State, taking into account the actualcircumstances of this Municipality.
  Article 2 (Scopeof Application)
  These Procedures apply to the settlementof disputes (hereinafter referred to as personneldispute (s)) arising from theestablishment, alteration, termination and dissolution of employment relationsbetween public institutions in the administrative area of this Municipality andtheir employed staff.
  Disputes arising from the establishment,alteration, termination and dissolution of employment relations betweennon-enterprise units run by the local people and social organizations usingauthorized posts of public institutions on the one hand and their employedstaff on the other may be settled according to these Procedures.
  These Procedures do not apply to thosepublic institutions that administer personnel in accordance with the statepublic servant system.
  Article 3 (Principlesof Settlement)
  The settlement of personnel disputesshall be based on facts, taking law as the criterion and following theprinciples of timeliness, fairness and reasonableness.
  Article 4 (Modesof Settlement)
  After a personnel dispute arises, theparties may resolve it by resorting to the following modes:
  (1) Consultationsby themselves;
  (2) Applying formediation;
  (3) Applying forarbitration.
  If the parties refuse to accept the awardof arbitration over a personnel dispute, they may file an action in a people'scourt according to law.
  Chapter II Mediation
  Article 5 (MediationOrganizations)
  Public institutions may establishmediation commissions for the settlement of personnel disputes. The personneldispute mediation commission shall be composed of the following personnel:
  (1)Representatives of employees elected by the workers and staff congresses or bythe general staff meetings;
  (2) Legalrepresentatives or their appointed representatives;
  (3) Representativesappointed by the trade unions.
  The personnel dispute mediationcommission shall be chaired by the representative appointed by the trade union,with its administrative office set up in the trade union committee.
  Higher departments in charge of thepublic institution may appoint a special mediation organization to mediatepersonnel disputes.
  Article 6 (MediationProvisions)
  After a personnel dispute arises, if theparties apply for mediation, the personnel dispute mediation commission or thedesignated special mediation organization (hereinafterreferred to as mediation organization(s)) shall urge both parties to reach a mediation agreement voluntarilyon the basis of the facts established.
  The contents of the mediation agreementmay not violate the provisions of laws, rules and regulations.
  Article 7 (MediationProcedure)
  When the parties apply to a mediationorganization for mediation, the organization shall mediate in a timely manner.If the mediation application is submitted by one party, the organization shallsecure the consent of the other party before undertaking mediation.
  In the course of mediation, the mediationorganization shall hear presentations by both parties and mediate impartiallyaccording to relevant provisions.
  When an agreement is reached aftermediation, the mediation organization shall prepare a written statement of themediation agreement, which shall go into effect upon signing by both parties;in case mediation fails, the mediation organization shall prepare a writtenmediation opinion and notify both parties that they may apply to the personneldisputes arbitration commission for arbitration.
  The mediation organization shall see thatboth parties to the personnel dispute implement the mediation agreement.
  Article 8 (TimeLimit for Mediation)
  After the parties apply to a mediationorganization for mediation, the mediation organization shall complete themediation proceeding within 50 days from the date of occurrence of the dispute;if the mediation is not completed by the end of the above time limit, themediation shall be deemed as a failure.
  Chapter III Arbitration
  Article 9 (Establishmentand Composition of the Arbitration Commission)
  Personnel dispute arbitration commissions(hereinafter referred to as arbitration commission(s)) shall be established at the municipaland district/county levels. Arbitration commissions shall be composed of thefollowing personnel:
  (1)Representatives of competent personnel administrative departments;
  (2)Representatives of the federation of trade unions;
  (3)Representatives of other relevant government departments.
  The arbitration commission shall becomposed of an odd number of members, with the representative of the competentpersonnel administrative department serving as the chairman.
  Article 10 (AdministrativeOffice of the Arbitration Commission)
  The arbitration commission shallestablish an administrative office under it to handle its day-to-day work, suchas accepting cases, serving arbitration documents, file management, arbitrationfees collection and management.
  The administrative office of thearbitration commission shall be set up in the competent personneladministrative department of the people's government at the same level.
  Article 11 (ArbitrationTribunal)
  When handling personnel disputes, thearbitration commission shall adopt the arbitration tribunal system. Thearbitration tribunal shall be composed of three arbitrators, with an arbitratorappointed by the arbitration commission serving as the chief arbitrator; in asimple case of personnel dispute, the arbitration commission may appoint asingle arbitrator as the sole arbitrator.
  Article 12 (Arbitrators)
  The arbitration commission may appointofficials of relevant government departments, experts, scholars and lawyers asfull-time or part-time arbitrators.
  In performing their public functions asarbitrators, part-time arbitrators shall enjoy the same rights as full-timearbitrators.
  Article 13 (ArbitrationJurisdiction)
  Personnel disputes that occur in thosepublic institutions established with the approval of the municipal people'sgovernment or its relevant competent departments and the Shanghai-basedinstitutions of central government departments, other provinces andmunicipalities shall fall within the jurisdiction of the municipal arbitrationcommission.
  Personnel disputes that occur in thosepublic institutions established with the approval of district/county people'sgovernments or their relevant competent departments shall fall within thejurisdiction of the district /county arbitration commissions.
  When district/county arbitrationcommissions differ in their opinions on the jurisdiction over a case, themunicipal arbitration commission shall designate its jurisdiction.
  Article 14 (ArbitrationApplication)
  Parties shall, within 60 days from thedate of occurrence of a personnel dispute, apply in writing to the arbitrationcommission that has jurisdiction for arbitration.
  The arbitration application shall specifythe following particulars:
  (1) If the claimantor respondent is an individual, his/her name, sex, age, occupation, work unitand address of residence shall be stated; if the claimant or respondent is aunit, the name and address of the unit, and the name and position of its legalrepresentative or the leading person-in-charge shall be stated;
  (2) The mattersat issue, the facts the application is based and its grounds;
  (3) Evidence andits source, the name and the address of residence of the witness(es).
  Article 15 (Acceptanceof Arbitration)
  The arbitration commission shall make adecision on acceptance or rejection within 7 workdays from the date of receiptof the arbitration application. In case of a rejection decision, the commissionshall notify the claimant in writing within 7 workdays from the date of makingthe decision and give the reasons for the rejection. In case of an acceptancedecision, the commission shall notify the claimant in writing within 7 workdaysfrom the date of making the decision and serve the duplicate copy of the arbitrationapplication on the respondent and form an arbitration tribunal.
  The respondent shall submit a statementof defense and related evidence within 10 workdays from the date of receivingthe duplicate copy of the arbitration application. Failure on the part of therespondent to submit a statement of defense in time or failure to submitdefense at all shall not affect the progress of the arbitration proceedings.
  Article 16 (Mediationby the Arbitration Tribunal)
  In case both parties are willing toaccept mediation, the arbitration tribunal, upon establishing the facts andattributing liabilities, shall urge the two parties to reach an agreementvoluntarily. The contents of the agreement may not contravene the provisions oflaws, rules and regulations.
  Where an agreement is reached throughmediation, the arbitration tribunal shall prepare a mediation decision. Themediation decision shall take legal effect upon signing receipt by bothparties.
  In case agreement is not reached throughmediation or the parties go back on it before signing receipt of the mediationdecision, the arbitration tribunal shall arbitrate without delay.
  Article 17 (Modesof Arbitration)
  Arbitration shall be conducted by holdinghearings. The arbitration tribunal shall notify in writing both parties of thetime and place of the hearing, as well as the list of its members 5 workdaysbefore the hearing. Where the parties agree not to hold a hearing, arbitrationin writing is also allowed.
  Article 18 (ActsDeemed as Withdrawal of Application and Arbitration by Default)
  Where a decision is made to hold ahearing for arbitration but the arbitration claimant fails to be present at thehearing without any proper reasons, though he is notified in writing, or leavesthe court before the hearing is over without permission of the arbitrationtribunal, the application may be regarded as being withdrawn.
  Where the respondent fails to be presentat the hearing without any proper reasons, though he has been notified inwriting, or leaves the court before the hearing is over without permission ofthe arbitration tribunal, an arbitration by default may be conducted.
  Article 19 (Evidence)
  The parties shall submit evidence tosupport their respective claims, unless otherwise provided by the State.
  The arbitration tribunal may collectevidence by itself if it deems it necessary.
  Only those evidences that have beencross-examined and confirmed may be taken as the basis for establishing thefacts.
  Article 20 (Debate)
  The parties have the right to debatetheir case in the course of arbitration. At the end of the debate, the chiefarbitrator or the sole arbitrator shall seek final opinions of the parties.
  Article 21 (ArbitrationAward)
  In arbitrating cases of personneldisputes, the principle of the minority being subordinate to the majority shallbe followed and dissenting opinions shall be recorded accurately. When amajority opinion can not be reached by the arbitration tribunal, an award shallbe made according to the chief arbitrator's opinion. The arbitration tribunalor the sole arbitrator shall prepare a written arbitration award within 5workdays after making the award.
  The arbitration award shall state thearbitration claims, facts under dispute, arbitration results and reasonstherefor, the allocation of arbitration fees, the time limit to institute legalproceedings with the people's court according to law in case of refusing toaccept the arbitration award and the date of the arbitration award. Thearbitration award shall be signed by the members of the arbitration tribunaland sealed by the arbitration commission.
  Article 22 (Handlingof Special Cases)
  When handling important or difficultpersonnel dispute cases, the arbitration tribunal may refer them to thearbitration commission for discussion and decision. The arbitration tribunalshall implement the decision of the arbitration commission.
  Article 23 (TimeLimit for Closing a Case)
  Personnel dispute cases handled by an arbitrationtribunal shall be closed within 60 days from the date of forming thearbitration tribunal; where necessary, appropriately deferred closure ofcomplicated cases may be allowed upon the approval of the arbitrationcommission, provided the deferment does not exceed 30 days.
  Article 24 (AuthorizedRepresentation)
  The parties may authorize one or twopersons to participate in the arbitration proceedings on their behalf. In caseof authorizing a third party to act as the representative, a power of attorneysigned or sealed by the principal shall be submitted to the arbitrationcommission. The power of attorney shall specify the entrusted matters and thelimits of authority.
  Article 25 (Challengeof Arbitrators)
  An arbitrator shall withdraw and theparties and their representatives also have the right to challenge him, when:
  (1) He is a partyto the case in question or a family member or close relative of either of theparties or his representatives;
  (2) He is astakeholder in the case;
  (3) He isotherwise related to a party to the case or to his representative, so that theimpartiality of the arbitration proceedings may be prejudiced.
  A challenge put forward by a party or hisrepresentative shall state the reason therefor and be submitted before thefirst hearing. In case the causes for the challenge become known after thefirst hearing, the challenge may be submitted before the end of the finalhearing.
  After receiving a challenge, thearbitration commission shall make a decision in writing within 3 workdays fromthe date of the submission of the challenge.
  Chapter IV Legal Liability and Relief
  Article 26 (LegalLiability of Parties)
  Where a party or any related person doesany one of the following acts in the course of arbitration, the arbitrationcommission may criticize, educate and order him to make corrections. In seriouscases involving violations of relevant provisions of"Regulation of the People'sRepublic of China on Public Security Administration and Imposition ofPunishment", the public security department may impose administrativepunishments according to law; if the wrongful act constitute a crime, thewrongdoer shall be prosecuted for criminal liability as provided by law:
  (1) Interferingwith arbitration proceedings;
  (2) Providingfalse information;
  (3) Takingreprisals against arbitrators or other working personnel, participants inarbitration or witnesses.
  Article 27 (LegalLiability of Arbitrators and Other Working Personnel)
  Where an arbitrator or other workingpersonnel engage in malpractice for selfish ends, accept bribes, carry outextortions, abuse power, or infringe upon the legitimate rights and interestsof the parties in an arbitration proceeding, the arbitrator shall bedisqualified as arbitrator and dismissed by the arbitration commission, whilethe other working personnel shall be dismissed by the arbitration commission;if the wrongful act constitute a crime, the wrongdoer shall be prosecuted forcriminal liability as provided by law.
  Article 28 (Litigationand Enforcement)
  If a party refuses to accept the award ofa personnel dispute arbitration, he may file an action in a people's courtaccording to law within 15 days from the date of receipt of the arbitrationaward. Where a party does not file an action or implement the arbitration awardwithin the statutory period, the other party may apply to the people's courtfor enforcement.
  Chapter V Supplementary Provisions
  Article 29 (ArbitrationFees)
  Parties applying for arbitration overpersonnel disputes shall pay arbitration fees in accordance with relevantprovisions.
  Article 30 (EffectiveDate)
  These Procedures shall become effectiveon October 24, 2004. The"Procedures of Shanghai Municipality on theSettlement of Disputes over Employment Contracts of Public Institutions"(SMPG G [2003] No.3) shall be annulled at thesame time.
